§ 58-31. Utility service board—Established, membership, terms, compensation.

  • (a)

    Operation of Logansport Municipal Utilities. On and after September 1, 1978, the Logansport Municipal Utilities will be operated by a utility service board.

    (b)

    Membership. The utility service board shall consist of five members, all of whom shall be residents of the area served by the Logansport Municipal Utilities. No fewer than three members shall be residents of the city. No member shall be a member of government.

    (c)

    Appointment. The mayor shall appoint three members to the utility service board, and the common council shall appoint two members to the utility service board. No political party shall have more than three members on such board.

    (d)

    Terms. The term of office for utility service board members shall be four years.

    (e)

    Appointments to fill expired terms. All members appointed to fill expired terms of members of the utility service board shall be appointed for a four-year term. The appointment shall be made by the authority that appointed the member whose term has expired.

    (f)

    Appointments to fill vacancies; removal. Any vacancy in the membership of the utility service board shall be filled by appointment for the unexpired term of the vacating member. Upon expiration of a term, death of a member, resignation of a member or a vacancy for any reason, such vacancy shall be filled by appointment by the authority which appointed the vacating member. The common council, with approval of the mayor, shall have the power to expel any member of the utility service board for violation of official duty or because of inability to perform his office. The common council shall have the power to hold hearings to determine if such cause exists for the termination of a member's appointment to the utility service board.

    (g)

    Election of officers; meetings. During its first meeting in August each year, the utility service board shall elect a chair, vice-chair and secretary. The secretary shall keep minutes of all proceedings, including the record of attendance of all members. The utility service board shall meet regularly on the fourth Tuesday of each month. If a need arises, the utility service board may hold such other meetings as provided by rule. All meetings shall be open to the public, except executive sessions as provided by law.

    (h)

    Compensation; attendance. Each member of the utility service board shall receive a salary of $100.00 per month. An additional fee of $20.00 per special meeting is established. Each utility service board member is required to attend all regularmeetings of the utility service board, and absence from three consecutive regular meetings of the utility service board shall be grounds for removal from office.

    (i)

    Source of compensation. Utility service board members' salaries and fees shall be drawn from each of the city's three utilities in proportion to the amount of revenue generated by each.
