§ 58-221. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Biochemical oxygen demand (BOD), of sewage, sewage effluent, polluted waters or industrial wastes, means the quantity of dissolved oxygen, in milligrams per liter, required during stabilization of the decomposable organic matter by aerobic biochemical action under standard laboratory procedures for five days at 20 degrees Celsius. The laboratory determination shall be made in accordance with procedures set forth in the Standard Methods.

    Chemical oxygen demand (COD), of sewage, sewage effluent, polluted waters or industrial wastes, means a measure of the oxygen equivalent of the portion of the organic matter in a sample that is susceptible to oxidation by a strong chemical oxidant. The laboratory determination shall be made in accordance with procedures set forth in the Standard Methods.

    City means the City of Logansport, Indiana, or any duly authorized official acting in its behalf.

    Equipment means all movable, nonfixed items necessary to the wastewater treatment process.

    Operation and maintenance expenses means all annual expenses, including replacement, related directly to operating and maintaining the sewage works as identified in the Uniform System of Accounts for Wastewater Utilities or as prescribed by the state board of accounts under the general headings Plant Operation and Maintenance, Sewer Operation and Maintenance, Customer Accounts, Administrative and General, Insurance and Taxes.

    Real property means all nonmovable, fixed-in-place items, such as structures and buildings, housing equipment or otherwise used in the wastewater treatment plant process.

    Replacement means expenditures for obtaining and installing equipment, accessories or appurtenances which are necessary during the service life of the treatment works to maintain the capacity and performance for which such works were designed and constructed.

    Sanitary sewage means sewage discharged from the sanitary conveniences of dwellings (including apartment houses and hotels), office buildings, factories or institutions and free from stormwater, surface water and industrial wastes.

    Service life means the period of time during which a component of a wastewater treatment works will be capable of performing a function. The maximum life components constructed under EPA Project No. C180295 are hereby set as follows:

    (1)

    Real property, 50 years commencing from January 1, 1978.

    (2)

    Process equipment, 30 years commencing from January 1, 1978.

    (3)

    Auxiliary equipment, 15 years commencing from January 1, 1978.

    Sewage means the water-carried wastes from residences, business buildings, institutions and industrial establishments, singly or in any combination, together with such groundwaters, surface waters and stormwaters as may be present.

    Sewer charges means a user charge and a local capital charge for debt service. For the purpose of this definition, the term "user charge" means a system of charges levied on users of a treatment works for the cost of operation and maintenance, including replacement, of such works. In addition, each user shall pay an amount sufficient to pay the debt service on any bonds, payable from the revenues of the sewage works. Prior to May 1 of each year, the superintendent of utilities shall prepare and present to the utility service board an accounting of operation and maintenance expenses, replacement costs and debt service for the immediately preceding calendar year and such board shall promptly request the common council to enact any change in the monthly sewer charges necessary to produce revenue proportionate to costs for each user and to maintain a schedule of charges deemed by it to be reasonable, nondiscriminatory and sufficient.

    Sewerage system means the network of sewers and appurtenances used for collecting, transporting and pumping sewage to the wastewater treatment plant.

    Sewerage works means all facilities for collecting, transporting, pumping, treating and disposing of sewage and sludge, namely the sewerage system and wastewater treatment plant.

    Strength-of-wastes surcharge means the extra user charges for sewerage service assessed users whose sewage is of such a nature that it imposes upon the sewage works a burden greater than that covered by the basic user charge.

    Surcharge means a charge for sewerage services in addition to the basic user and debt service charges.

    Suspended solids means solids which either float on the surface of, or are in suspension in, water, sewage or other liquid and which are removable by laboratory filtration. The concentration of such suspended solids shall be expressed in milligrams per liter. Quantitative determinations shall be made in accordance with procedures set forth in the Standard Methods.

    User classes. Each recipient of municipal wastewater treatment services shall be either in the industrial class or the nonindustrial class, including domestic, commercial, institutional and governmental.

    (1)

    Industrial class includes any user, as determined by the board of public works and safety, identified in the Standard Industrial Classification Manual of 1972, Office of Management and Budget, as amended and supplemented, under the following divisions:

    a.

    Division A—Agriculture, forestry and fishing;

    b.

    Division B—Mining;

    c.

    Division D—Manufacturing;

    d.

    Division E—Transportation, communications, electric, gas and sanitary services; and

    e.

    Division I—Services.

    (2)

    Nonindustrial class includes all users whose wastes are segregated domestic wastes or wastes from sanitary conveniences, where regular domestic wastes are the wastes generated by normal domestic activity, as determined by the board of public works and safety.

    Wastewater treatment plant means the arrangement of devices, structures and equipment used for treating and disposing of sewage and sludge.
