§ 50-62. Interfering with, displacing, breaking or tearing down leads, lines or wires.

  • (a)

    Prohibited. It shall be unlawful for any person to move any house or structure on or along the streets, alleys or public ways of the city so as to interfere with, displace, break or tear down any telephone, electric light or telegraph leads, lines or wires, the location of which has been authorized by the city, except upon the conditions and terms set forth in this section.

    (b)

    Procedure for raising or removing lines and wires. The mover of any such house or structure desiring to cross or go through any such wires or lines shall give the local manager thereof in the city 24 hours' previous written notice of his intention and desire to do so, specifying the streets and routes along which he proposes and desires to move the house or structure, and it shall then be the duty of the manager or agent in charge of such wires to raise or remove the wires with the least practicable expense so as to permit such structure to be moved through or past the wires according to the specification of such notice, and the reasonable cost and expense of the removal and replacement of such wires shall be paid by the house mover giving such notice. Nothing in this subsection shall be construed as dispensing with the permit required before moving any building.

    (c)

    Failure to pay expenses. Should the mover of such house or structure fail to pay such expense on demand, he shall have no further right to again go through or require the removal of such wires until such bill is paid.
